These Terms and Conditions ("Terms") govern your access to and use of the FutbolConnect mobile application, website, and related services ("Services") provided by FutbolConnect, Inc. ("FutbolConnect", "we", "our", or "us"), a Delaware C-Corporation headquartered in Santa Clara, CA.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

These Terms govern your platform membership and conduct. For software license terms, see our EULA. For data practices, see our Privacy Policy.

01. Acceptance of Terms

By creating an account, downloading, or using the Services in any way, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and EULA, all of which are incorporated herein by reference.

We reserve the right to update these Terms at any time. We will notify you of material changes via in-app notice or email. Your continued use of the Services after any update constitutes acceptance of the revised Terms.

You must be at least 13 years old, or the age of digital consent in your region, to use the Services.

By using the Services, you represent and warrant that you meet all eligibility requirements. If you are using the Services on behalf of a minor, you accept these Terms on their behalf and are responsible for their use of the platform.

We reserve the right to refuse access to any person who does not meet these requirements.

03. User Accounts

You Are Responsible for Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not authorized by you.

Accurate InformationYou agree to provide truthful, current, and complete registration information and to update it as necessary.

One Account Per UserYou may not create multiple accounts or impersonate another person or entity.

Notify BreachesYou must immediately notify us at info@futbolconnect.com of any unauthorized use of your account.

Account SuspensionWe may suspend or terminate accounts that violate these Terms, are inactive for extended periods, or pose security risks.

04. User Content

"User Content" refers to any content you upload, post, or share through the Services, including profile photos, videos, performance statistics, posts, and comments.

You retain ownership of your User Content. By uploading content, you grant FutbolConnect a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your content solely within the Services and according to your privacy settings.

You agree not to upload or share content that:

Is illegal, abusive, defamatory, or harassing

Violates the rights of others, including privacy or intellectual property rights

Contains copyrighted material you do not have permission to use

Includes unauthorized personal data of other individuals

Violates applicable league, organizational, or regulatory rules

Is false, misleading, or fraudulent

Contains sexually explicit or violent content

FutbolConnect reserves the right to remove any User Content that violates these Terms, without notice or liability.

05. Prohibited Conduct

When using the Services, you agree that you will not:

Unauthorized AccessAttempt to access another user's account or any non-public area of the Services

Interfere with the PlatformDisrupt, damage, or interfere with the operation of the Services or servers

Use Bots or AutomationUse automated scripts, bots, scrapers, or crawlers to access or interact with the Services

Upload Harmful CodeTransmit malware, viruses, ransomware, or any other malicious or disruptive code

Impersonate OthersFalsely represent yourself as another user, FutbolConnect employee, or any other person or entity

Harassment or AbuseHarass, threaten, bully, or intimidate other users in any way

Unauthorized Commercial UseUse the Services for commercial advertising or solicitation without express written authorization

Violate LawsUse the Services in any way that violates applicable local, national, or international laws or regulations

Circumvent SecurityAttempt to bypass, disable, or interfere with any security or access control feature of the Services

06. Payments & Subscriptions

Some features of the Services require a paid subscription or in-app purchase. All billing is handled securely through the Apple App Store or Google Play Store.

Auto-RenewalSubscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period through your App Store account.

RefundsAll refund requests are governed by the Apple App Store or Google Play refund policies. FutbolConnect does not process refunds directly.

Price ChangesWe may change subscription pricing at any time. You will be notified in advance of any price change affecting your active subscription.

Payment SecurityFutbolConnect does not store your full credit card numbers. All payment data is handled by Apple or Google's secure billing infrastructure.

Manage or cancel your subscription at any time through your Apple or Google account settings.

07. Advertising

The Services may display advertisements or sponsored content. For users aged 13 and older, ads may be personalized based on your profile and usage data if you have consented to data collection for advertising purposes.

Users 13+May receive age-appropriate personalized ads based on consented data

Users Under 13Will not receive personalized ads; no ad tracking

Ad ContentAll ads comply with Google Families Ads Program requirements and applicable standards

No Disruptive AdsWe do not serve deceptive, disruptive, or harmful advertising

08. Third-Party Services

The Services may link to or integrate with third-party platforms, websites, or services not owned or controlled by FutbolConnect. We are not responsible for the content, privacy practices, or terms of any third-party service.

Your interactions with third-party services are governed solely by their own terms and privacy policies. We encourage you to review those policies before engaging with third-party integrations.

FutbolConnect is not liable for any loss or damage arising from your use of third-party services or content.

09. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant continuous, uninterrupted, or error-free access to the Services.

We do not warrant the accuracy or completeness of user-submitted data, training analytics, or performance metrics.

Training analytics and performance metrics are provided for informational purposes only and are not scientifically validated. Use of the Services for physical training is at your own risk.

We are not responsible for injuries, damages, or losses arising from physical sporting activities facilitated by the Services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, FutbolConnect, its officers, directors, employees, agents, and licensors shall not be liable for:

Indirect, incidental, consequential, special, or punitive damages of any kind

Loss of profits, data, goodwill, or other intangible losses

Damages resulting from unauthorized access to your account or data

Damages caused by User Content posted by you or other users

Damages resulting from your inability to access or use the Services

Physical injuries arising from training or sporting activities facilitated by the Services

Losses resulting from your reliance on information obtained through the Services

In no event shall FutbolConnect's total aggregate liability to you for all claims arising from or relating to these Terms or the Services exceed the greater of (a) the amount you paid to FutbolConnect in the twelve (12) months preceding the claim, or (b) $100 USD. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless FutbolConnect, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, and expenses (including legal fees) arising out of or relating to:

Your use of or access to the Services

Your violation of any provision of these Terms

Your violation of any third-party right, including intellectual property or privacy rights

Any User Content you post, upload, or share through the Services

12. Account Termination

FutbolConnect reserves the right to suspend or permanently terminate your account and access to the Services at our sole discretion, without notice or liability, for:

Violation of these Terms or our EULA

Illegal or fraudulent activity

Safety or security concerns

Nonpayment of subscription fees

Extended period of account inactivity

At our sole discretion for any reason

You may delete your account at any time through the Account Settings in the app. Upon termination, your license to use the Services ends immediately. Sections of these Terms that by their nature should survive termination shall survive, including Ownership, Disclaimer, Limitation of Liability, Indemnification, and Governing Law.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Delaware. By using the Services, you consent to personal jurisdiction in those courts.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

Changes to These Terms

We may update these Terms at any time. When we do, we will revise the Effective Date above and notify you via in-app notice or email. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
